The parts are based on proprietary designs and require specific safety certifications, which means no other supplier can legally or practically produce them to the required standards.\nTherefore, this direct award is in line with the permissible provisions under Section 41, Schedule 5 of the Procurement Act 2023 which calls for reason to award directly to the OEM in the absence of intellectual property and exclusive rights, with no reasonable alternatives to those goods. Any part/goods purchased from alternate supplier other than the OEM could result in disproportionate functioning of the door systems, thereby risking the functionality and potentially causing safety hazards on a running train.",
