Please see below for a description of the circumstances surrounding the award of this contract. \nNESO Published a PIN notice on the 11th of November (under Procurement identifier (OCID): ocds-h6vhtk-04b588) pursuant to the Utilities Contracts Regulations 2016 (UCR) \nFurther to the Cabinet Office guidance on the transitional arrangements, NESO accepts that its use of a PIN as a call for competition was incorrect and that the opportunity should have been advertised using a UCR compliant contract notice. The award of this contract is therefore governed by the Procurement Act 2023. Other than this technical error, NESO is satisfied that it complied with the general procurement principles of equal treatment, transparency and proportionality and that the procurement process was successful in identifying the most advantageous tender \nThe process has now concluded and NESO will be making a direct award to the supplier that submitted the most advantageous tender . NESO will publish a Contract Award Notice in due course.",
