The Building Safety Regulator (BSR) will be transitioned out of HSE into MHCLG. To support this transition, HSE is seeking a 12 month contract extension of the current contract that is in place with PA Consulting (PA) for the design and build of a case management system for BSR. The contract extension is required for PA to deliver and facilitate a range of workshops as well as provide strategic advice and guidance to support the segmentation, separation and physical transfer of the case management system to the new BSR infrastructure whilst ensuring an appropriate instance of the developed system remains on HSE's infrastructure to ensure we are able to retain access to the appropriate components and functionality required to meet our needs going forwards. PA will also be required to support and advise on the physical transfer of the system to the new bodies infrastructure. PA Consulting has a vast understanding of the BSR Programs and services as they support the development and therefore have the skillset and knowledge base required to support a successful transition from the start. The delivery of the support will include various call-off periods, and HSE will only pay for the effort once it has been approved. The anticipated cost for the support over the period will not exceed £5 000 000.00 (£5 Mil) and will be calculated based on the existing contract rate card. It is not possible to consider other tender options that are expected to take between 6-12 months to conclude.

"description": "HSE are considering varying the existing contract with PA Consulting for the design and build of a BSR Case Management system, to allow them to support and manage the transition of the system they have designed, developed and built on behalf of HSE to the new BSR body. We are seeking to rely on the provisions of Reg 72 1 b (i) and (ii) to do so. \nIn respect of Reg 72 1 b (i) - the argument supporting economic reasons, is primarily being that the current contract was let using the CCS DOS 5 framework four years ago. That framework has now been replaced by the CCS DOS 6 framework and the new framework rates have increased substantially compared to the old ones. This would create a substantial additional finance burden. More substantively the technical issues that would be experienced if we failed to direct award. The system built by PA Consulting has been substantially configured to HSE\u0027s requirements and it is intrinsically linked to a number of critical HSE systems and it is important that HSE appoints a supplier to support the transition work, which was not HSE\u0027s decision and needs to be undertaken within an extremely challenging timeframe, who understands the intricacies of the system and its interaction with HSE\u0027s other systems to ensure that appropriate security protocols and separation provisions can be maintained given that individual components of the system will need to be retained and used by HSE on its IT estate.\nThe rationale supporting the use of Reg 72 1 b (ii) is that engaging anyone other than PA Consulting to deliver this work is going to require a substantial financial and time commitment from any new supplier to understand the system which would be a substantial duplication of costs given that HSE has already paid PA a substantial amount of money to have that understanding. It would in all likelihood require that HSE also pay PA further sums to engage with any new supplier to support them as they develop their understanding of the system. The final point is that the engagement of anyone else to do this work would also cause HSE significant inconvenience as a substantial amount of staff resource would be required to support any new contractor in delivering this work, which wouldn\u0027t be required to the same extent if it is delivered by PA. This resource is scarce, expensive and isn\u0027t available because it is already being utilised to support other elements of the transition process. HSE cannot backfill this resource in the timeframe required without incurring significant costs and even if it were able to do so there would be a significant impact on HSE\u0027s ability to deliver BAU activity in an environment that is currently subject to a high level of public and political scrutiny.\nThe original contract value was circa \u00a316m, prior to a previous uplift. The proposed uplift in contract value is \u00a35m, which is within the 50% permitted by the Procurement Regulations.\nThe total contract value will now be \u00a324,801,210.00",
